Official Rules
The Times Herald and TimesHerald.com’s “Build A Ball Player Photo Contest”
NO PURCHASE NECESSARY TO ENTER OR WIN
A PURCHASE OF THE TIMES HERALD WILL NOT INCREASE YOUR CHANCES OF WINNING
I.ELIGIBILITY: The Times Herald’s “Build A Ball Player” Promotion (the “Promotion”) is open to legal residents of Pennsylvania who are 18 years of age or older at time of entry. Employees, officers and directors (including without limitation their children, parents, siblings and spouses and/or individuals living in the same household) of The Times Herald, its parents, affiliates and subsidiaries are not eligible.
II.TO PLAY: Upload a photograph by visiting http://ballplayer.timesherald.com and completing the required registration information. Photograph must be original. By entering a photograph into the Promotion, participants acknowledge The Times Herald and TimesHerald.com’s right to reproduce the photograph for promotional purposes -- including in print, online, broadcast, et all.
III.Photos posted must be posted by March 22, 2009 to be eligible for the contest. Any disputes concerning photo eligibility will be determined by The Times Herald and TimesHerald.com and those decisions are final.
IV.Contest voting: Votes may be cast by anyone visiting http://ballplayer.timesherald.com between March 23, and March 30, 2009. The winner will be determined by a combination of reader/user votes and by The Times Herald and TimesHerald.com. This decision is final.
V.Prizes: There will be one prize level awarded for the Promotion
Photo Prize: One Ryan Howard Fathead worth about $100 and two tickets to a Phillies game worth about $80. (1st place)
CLAIMING PRIZE: The winner will be contacted by The Times Herald, by April 7, 2009. The winner must make an appointment to come to The Times Herald and must present his/her driver’s license and/or picture id matching the information provided during registration. The name on the id MUST match the name on the registration. No exceptions.
VI.GAME PRIZES/ODDS OF WINNING: All prizes, for a total of approximately $180, will be given away as follows: One (1) Grand Prize of an approximate value of $180.
THE ACTUAL ODDS OF WINNING THE GRAND PRIZE AND DAILY PRIZE WILL DEPEND ON THE NUMBER OF ENTRIES. THE ACTUAL ODDS OF WINNING A DAILY PRIZE WILL DEPEND ON THE NUMBER OF ENTRY FORMS RECEIVED AS DESCRIBED ABOVE.
VII.GENERAL TERMS:
Taxes: Each prize winner shall bear sole responsibility for any and all local, state or federal taxes on prizes and any expenses not specified herein relating to winner’s acceptance and use of the prize.
Conditions of Participant: By participating in this Promotion, each entrant agrees:
1.That these rules and all related decisions of The Times Herald and TimesHerald.com shall be final in all respects relating to this Promotion.
2.To release, discharge, and hold harmless The Times Herald and TimesHerald.com, its parents, subsidiaries and affiliates, and each of their respective directors, officers, shareholders, agents, and employees (collectively, “Releasees”) from any and all injuries, liability, losses, and damages of any kind resulting from their participating in the Promtoion or their acceptance, use, or misuse of a prize, including, without limitation, personal injury, death and property damage.
3.To the announcement/use of his/her name, voice, image, and/or likeness for trade, advertising publicity, and promotional purposes without compensation (unless prohibited by law) by The Times Herald and TimesHerald.com and those acting pursuant to The Times Herald and TimesHerald.com’s direction, in each case in any and all media now known or hereafter discovered, worldwide, in perpetuity, including but not limited to the World Wide Web, without notice, review, or approval, and agree to execute specific consent to such use if asked to do so.
4.That, in the event he or she wins a prize of $1,000 or more, he or she will complete, sign and return an Affidavit of Eligibility, a Liability Release and a Publicity Release within 14 days of notification. Failure to timely return documents or return of a prize notification or prize as undeliverable will cause prize to be forfeited. Releases are not responsible for and shall not be liable for: (a) any human, typographical, printing or other error relating to or in connection with the Promotion, including without limitation, errors which may occur in the administration of the Promotion, processing of entries or requests for entry forms, the announcement of the prizes or in any Promotion-related materials; (b) late, lost, misdirected, incomplete, illegible, mutilated, stolen, delayed, or postage-due entries; or (c) any condition caused by events that may cause the Promotion to be disrupted or corrupted.
5.That The Times Herald and TimesHerald.com reserves the right in its sole discretion to cancel, terminate, modify, or suspend the Promotion if fraud, technical failures or any other factor beyond its reasonable control impairs the integrity of the Promotion (or portion thereof), as determined by The Times Herald and TimesHerald.com in its sole discretion. Entry forms become the property of The Times Herald and TimesHerald.com and will not be returned. Entry forms are void if not obtained in accordance with these Official Rules, or if any part is forged, illegible, counterfeited, incomplete, mechanically reproduced, photocopied, altered, mutilated or tampered with in any way, or if they contain printing, production, typographical, mechanical or other errors.
6.In order to claim a winning prize you will be required to come to The Times Herald, 410 Markley Street, Norristown, PA 19404 and provide proof of identification with a driver’s license and/or picture ID. Winners must comply with all contest rules or prizes will be forfeited. Winners agree to allow use of their names and pictures by The Times Herald and TimesHerald.com for publicity purposes.
VIII.MISCELLANEOUS: For a copy of these Official Rules, mail a self-addressed, stamped envelope to 410 Markley Street, Norristown, PA 19404
